    Terms of Service

    1. Acceptance of Terms

    By accessing and using Janney AI's services, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.

    2. The Service

    Janney AI provides a database of creators on TikTok, Instagram and YouTube with search, lookalikes and creator details; a CRM for your creator relationships (lists, tags, notes, CSV import and export, and an optional read-only mailbox connection); contact details for creators, charged in credits; tracking of the public performance of posts you choose; and a REST API and hosted MCP server through which your own tools and AI agents can use the database. Custom plans are provided under a separate written agreement.

    • Creator data is sourced, not guaranteed. It comes from public pages and third-party providers. We do not warrant that it is complete or current, that a contact detail is deliverable, or that an account is still active. Audience figures, engagement figures and value estimates are estimates for reference.
    • Contacting creators is your responsibility. You decide whether and how to contact a creator, and you must comply with the laws that apply to you, including anti-spam, privacy and marketing laws, and with the terms of the platforms involved.
    • Your AI tools act for you. When you connect an AI agent or your own software to Janney through the API or MCP, its actions count as yours. API keys and MCP connections are confidential to your workspace and may not be shared outside it.
    • Fair use. Search, lookalikes, lists and tracking are subject to the limits of your plan and to fair-use limits that protect the Service for everyone.

    3. Use License

    Permission is granted to access and use Janney AI's platform for your own influencer marketing, for your company or your clients. This is the grant of a license, not a transfer of title, and under this license you may not:

    • Modify or copy the materials, or remove any copyright or other proprietary notations from them
    • Attempt to reverse engineer any software contained on Janney AI's platform
    • Transfer the materials to another person or "mirror" the materials on any other server
    • Use bots, scrapers, headless browsers, or any automated or scripted means to access, search, paginate, or extract data outside the API and MCP server we provide, whether to exceed plan limits, bulk-harvest data, or otherwise. Interactive search is for genuine human use and is subject to fair-use limits; automated or scripted usage may be throttled, suspended, or terminated without notice
    • Use the Service, its data, or its outputs for unfair competition, or to build, train, or benchmark a competing product, model, or dataset
    • Resell, sublicense, publish or redistribute the database, or the data or contacts obtained through the Service, except as expressly permitted. Using contacts for your own campaigns, and sharing lists within your workspace or with the client a campaign is for, is permitted
    • Share API keys or MCP connections with anyone outside your workspace
    • Use the Service for any unlawful, deceptive, fraudulent, or abusive purpose

    4. Competitors and Competitive Use

    The Service is offered to brands, agencies and creators for their own influencer marketing. It is not offered to our competitors. A "Competitor" is any person or organization that develops, offers or sells, or is preparing to develop, offer or sell, a product or service that competes with the Service, including creator discovery, creator data, creator CRM or campaign management software, together with its employees, contractors, agents and anyone acting on its behalf.

    Without our prior written consent, you may not:

    • Register for, access or use the Service, including any free trial, demo account, API or integration, if you are a Competitor or are acting on behalf of or for the benefit of one
    • Access or use the Service, or any demo, trial, sales meeting, pricing, documentation or other material we share with you, for benchmarking, comparison, monitoring of its availability, performance or functionality, or any other competitive purpose, or publish or share the results of any such analysis
    • Reverse engineer, decompile, disassemble or otherwise attempt to derive the source code, models, prompts, algorithms, data structures, workflows or underlying ideas of the Service, or copy its features, functions, interface or content
    • Gather competitive intelligence about Janney AI, including by requesting demos, booking sales calls, starting trials or posing as a prospective customer, or use any information obtained from the Service or from us to build, improve, train, market or sell a competing product or service
    • Misrepresent your identity, employer or affiliation, or use a personal or third-party email address, a reseller or any other intermediary to obtain access that would otherwise be refused

    Access obtained in breach of this section is unauthorized. We may refuse, suspend or terminate it at any time without notice or refund, and we reserve all rights and remedies available to us at law and in equity, including injunctive relief and the recovery of damages.

    5. User Accounts

    When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

    You are responsible for safeguarding the credentials, API keys and MCP connections used to access the Service, and for any activities or actions taken with them, including by the AI agents and tools you connect.

    6. Intellectual Property

    The Service and its original content, features, and functionality, including the database as a compilation, are and will remain the exclusive property of Janney AI and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

    7. Your Content

    You retain all rights to the lists, tags, notes, files and other content you submit to the Service. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process and display that content solely to operate and support the Service for you and your workspace. We do not use your content to train generalized AI models.

    8. Payment Terms and Credits

    Paid services are billed in advance on a monthly or annual basis and are non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account. We will give you at least 30 days' notice of any price change before it takes effect at your next renewal.

    Contact details are charged in credits: one credit per creator for whom a contact detail is found, and nothing when none is found. Searching, lookalikes, lists and tracking do not use credits. Credits included in a subscription roll over while the subscription remains active; upon cancellation or expiration, any remaining credits are forfeited at the end of the then-current billing period. API usage is charged as shown on the API page.

    9. Termination

    We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. You may export your lists before closing your account.

    10. Disclaimer and Limitation of Liability

    The Service and its data are provided "as is" and "as available", without warranties of any kind, express or implied, including as to the accuracy, completeness or currency of creator data, contact details, audience figures or estimates.

    In no event shall Janney AI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses. Our total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the twelve months before the claim.

    11. Governing Law

    These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Janney AI operates, without regard to its conflict of law provisions.

    12. Changes to Terms

    We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page and updating the "Last updated" date.
